Terms of Service

1. Agreement to terms

These Terms of Service constitute a legally binding agreement between you, personally or on behalf of an entity, and Krishna Creations, concerning your access to and use of our web design, development, and hosting services. By accessing our Services, you agree that you have read, understood, and agreed to be bound by these Terms.

2. Intellectual property rights

Unless otherwise indicated, the Site and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics, and the trademarks, service marks, and logos contained therein are owned or controlled by us.

Upon final and unencumbered payment of all project invoices, Krishna Creations transfers the commercial usage rights of the designed website frontend to the Client. Proprietary framework infrastructure, raw pre-compiled CMS codes, and reusable component libraries built by us remain the intellectual property of Krishna Creations.

3. Client obligations

By engaging in a contract with us, you warrant that you have the legal capacity to comply with these Terms; will promptly provide assets needed for the development timeline, including copywriting, high-resolution logos, and product photography; and that those assets do not infringe third-party intellectual property rights.

4. Fees and payment

Unless otherwise specified in a signed Contract Proposal, a non-refundable 50% architectural deposit is required before wireframing or coding commences. The remaining 50% balance must be settled upon domain launch or handover of the master repository files.

If payment is withheld or delayed beyond 15 calendar days post-deployment, we reserve the right to suspend the website's hosting infrastructure until the balance is cleared.

5. Revisions & timelines

Turnaround times depend on prompt client feedback. Standard web packages include two (2) consolidated rounds of major revisions during the wireframe phase. After structural design approval and the start of backend coding, structural changes may incur additional hourly fees at standard agency rates.

6. Cancellation & refunds

The initial 50% technical deposit is strictly non-refundable due to the manual labor and infrastructure costs dedicated upon project initialization. If you cancel mid-development, completed work milestones up to that date will be compiled, accurately invoiced, and billed before final termination of the contract.

7. Limitation of liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or the services delivered.

8. Governing law

These Terms are governed by the laws of India. Krishna Creations and yourself irrevocably consent that the courts of Prayagraj, Uttar Pradesh shall have exclusive jurisdiction to resolve any dispute arising in connection with these terms.
